Stick With Ellen Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A purchase will not increase your chances of winning. The entry period for The Ellen Watch and Win Summer Sweepstakes (the "Sweepstakes"), sponsored by WAD Productions, Inc. (the “Sponsor”), begins August 4, 2008 at 9:00 a.m. PT and ends August 22, 2008 at 11:59 p.m. PT (the “Entry Period”). Sponsor’s computer is the official time keeping device for the Sweepstakes. Void where prohibited.

1. ELIGIBILITY:

The Sweepstakes is open to individuals who are at least eighteen (18) years of age or the age of majority in their state of residence on the date of entry, a legal resident of and physically located in the fifty (50) United States (including DC but excluding Puerto Rico, United States territories, possessions, and protectorates, and foreign based United States military installations).

Potential Sweepstakes prize winner and guest must be able to travel to Los Angeles, California as early as September 2, 2008 and stay in Los Angeles until September 5, 2008. Neither Sponsor nor employees of Sponsor, the Ellen DeGeneres Show, broadcast licensees of The Ellen DeGeneres Show, Time Warner, Warner Brothers Entertainment, Telepictures Productions, Inc. and all of their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, distributors, advertising, promotion and public relations agencies and their respective officers, directors, employees, agents, independent contractors, representatives and agencies (collectively, the "Sponsor Entities") are eligible to participate in the Sweepstakes and/or win the Prizes (as defined below). Additionally, relatives of such employees and persons living in the same household as such employees (whether related or not) are not eligible to win. For the purposes of this Sweepstakes, “relatives” is defined as spouse, domestic partner, parent, in-laws, grandparent, brother, sister, children and grandchildren.

2. HOW TO ENTER:

The only way to enter the Sweepstakes is via the internet. To enter, watch an episode of “The Ellen DeGeneres Show” (the “Show”) during the Entry Period. Then, log on to www.ellentv.com the same day on which the episode of the Show you watched was broadcast, find the information that refers to the Sweepstakes and follow the appropriate links to register. Register for the Sweepstakes during the Entry Period by including your name, your complete mailing address (P.O. Boxes not accepted), your primary phone number (with area code), your cell phone number or alternate phone number (if any) (with area code), your birth date and your e-mail address. In addition, you must answer the question found on the entry page relating to the episode of the Show that was broadcast on the day you enter the Sweepstakes. Limit: one (1) entry per day during the Entry Period per household/valid e-mail address. As used herein, a “day” means that period commencing at 9 a.m. PT and ends at 11:59 p.m. PT. All entries for any one day during the Entry Period must be received by 11:59 p.m. (PT) on the date of entry; entries received after 11:59 p.m. (PT) will be disqualified. Entries will not be accepted on any Saturday or Sunday during the Entry Period; entries received on a Saturday or Sunday during the entry period will be disqualified. Only those entries which correctly answer the Show-related question asked on the date of entry will be eligible to be included in the daily, weekly and grand prize drawings. Entries with an incorrect answer to the Show-related question asked on the date of entry will be disqualified. ENTRIES MUST BE RECEIVED BY:

--11:59 p.m. PT Monday through Friday during the Entry Period to be eligible for that day’s daily prize drawing;
--11:59 p.m. PT on any Friday during the Entry Period to be eligible for that week’s weekly prize drawing;
--11:59 p.m. PT on August 22, 2008 to be eligible for the Grand Prize drawing.
All entries become the property of Sponsor and will not be acknowledged or returned, and all information therein will be used solely in connection with the administration of the Sweepstakes and the awarding of Prizes, in accordance with applicable law. Every entry submission must be manually keystroked and manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot, or Sweepstakes service) will be disqualified and transmissions using automated and/or repetitive electronic submission methods from any related e-mail or IP addresses may be blocked.

3. SELECTION OF SWEEPSTAKES WINNERS

DAILY DRAWINGS: One (1) daily prize winner will be chosen each day during the Entry Period commencing August 5, 2008 from all eligible entries received on the previous day. The drawing for entries received on Fridays during the Entry Period will be conducted on the Monday immediately following that Friday. No daily prize drawings will be conducted on Saturdays or Sundays during the Entry Period. The potential daily winners will be notified via telephone and/or e-mail on or about the day on which the potential daily winner’s entry is drawn that he or she, subject to verification, is the winner of one of the daily prizes (defined below). Odds of winning a daily prize depend on the number of eligible entries containing the correct answer to the Show-related question are received prior to the entry deadline for that day. Eligible entries not selected during any daily prize drawing will be entered into and eligible to win the next weekly prize drawing.
WEEKLY DRAWINGS: One (1) weekly prize winner will be chosen on the Monday immediately following each Friday during the Entry Period from all eligible entries received during that previous week (except for entries received from any daily prize winner selected during any previous daily winner drawing). The potential weekly winners will be notified via telephone and/or e-mail on or about the day on which the potential weekly winner’s entry is drawn that he or she, subject to verification, is the winner of one of the weekly prizes (defined below). A “week” is defined as beginning at 9 a.m. PT on a Monday and ending at 11:59 p.m. PT on the following Friday during the Entry Period. Odds of winning a weekly prize depend on the number of eligible entries containing the correct answer to the Show-related question asked on the date of their entry. Eligible entries not selected during any weekly prize drawing will be entered into and eligible to win the next weekly prize drawing.
GRAND PRIZE DRAWING: One (1) grand prize winner will be chosen on or about August 25, 2008 from all eligible entries received during the Entry Period (including entries from those selected as daily and weekly prize winners). The potential grand prize winner will be notified via telephone and/or e-mail on or about August 25, 2008 that he or she, subject to verification, is the grand prize winner (defined below). All eligible entries received during the Entry Period will be entered into and eligible to win the Grand Prize. Odds of winning the Grand Prize depend on the number of eligible entries received during the Entry Period which contain the correct answer to the Show-related question asked on the date of entry.
If any potential daily, weekly or grand prize winner (i) cannot be reached, (ii) fails to respond to the Prize notification, and/or (iii) declines the Prize, an alternate daily, weekly or grand prize winner (as applicable) may be selected in Sponsor’s sole discretion. Sponsor is not obligated to leave a voice mail message on a potential winner’s answering machine nor is Sponsor required to send more than one e-mail notification to a potential winner. If the potential winner, within twenty-four (24) of Sponsor’s Prize notification, (i) fails to return a completed affidavit of eligibility, liability/publicity release, or other documents(s) as required by Sponsor, (ii) fails to provide Sponsor with a copy of his/her valid government issued photo identification or social security number, and/or (iii) is found to be ineligible, an alternate winner may be selected at Sponsor’s sole discretion. Sponsor reserves the right to modify the notification and affidavit/release procedures in connection with the selection of an alternate winner, if any. The address provided by each entrant on the Sweepstakes entry form shall serve as the address of record in respect of all mailings to each -entrant. Changes to such mail address may serve as a basis for disqualification. All winning entries are subject to verification of entrant’s eligibility and full compliance with these Official Rules before such potential winner can be declared an official winner and become entitled to receive any Prize

4. PRIZES:

DAILY PRIZES (15): Each daily prize winner will receive one (1) Show gift bag and one (1) $50 gift card from Shopzilla.com. Limitations on gift card may apply. Approximately Retail Value (“ARV”) of each Show gift bag: $25.00; Total ARV of all Daily Prizes: $1,125.00. Limit: one (1) daily prize per person/valid e-mail address during the Entry Period.

WEEKLY PRIZES (3): Each weekly prize winner will receive one (1) $250 gift card from Shopzilla.com. Limitations may apply. Total Retail Value: $750.00. Limit: one (1) weekly prize per person/valid e-mail address during the Entry Period.

GRAND PRIZE WINNER (1): The Grand Prize Winner will receive the following:

(a) Roundtrip coach airfare for two (2) (the Grand Prize Winner and one (1) guest) to Los Angeles, California on or about September 2, 2008 from a major airport near Grand Prize winner’s home (as determined by Sponsor in its sole discretion);

(b) Two (2) VIP tickets to attend the September 3, 2008 taping of the Show;

(c) Hotel accommodations (double occupancy) selected by Sponsor in its sole discretion in Los Angeles for Grand Prize winner and guest for three days/two nights; and

(d) Ground transportation or transfers to and from the Los Angeles airport, the hotel and the taping location.

Total ARV of Grand Prize: $3,000.00

TOTAL ARV OF ALL PRIZES: $4,875.00.00

If in the judgment of Sponsor air travel is not required due to Grand Prize winner’s proximity to the Grand Prize travel location, roundtrip ground transportation will be substituted for roundtrip air travel. The difference in value will not be awarded in cash.

Air travel must be roundtrip; no layovers or stopovers allowed. Travel is subject to the terms and conditions set forth in these Official Rules and those set forth by the airline carrier as detailed in the passenger ticket contract. Reservations and airline tickets are non-refundable for cash or credit, non-transferable and non-changeable once issued. The airline tickets cannot be sold, exchanged or bartered. If lost, they will not be replaced. Each winner and his/her guest are responsible for insurance and any other required travel documents, including valid identification. All expenses not specifically set forth herein including, without limitation, meals, beverages, telephone charges, movie charges, pay-per-view television charges, hotel room-service charges, merchandise, souvenirs, and any other incidental costs and expenses shall be the sole responsibility of each winner and his/her guest who incur such charges. Traveling companion must be at least 18 years of age or older on departure date and not a minor in his/her state of residence, unless winner is parent or legal guardian of the traveling companion. All details of the prize are at Sponsor’s sole discretion. If prize winner is unavailable to travel on dates specified by Sponsor, the prize will be forfeited and Sponsor shall have the right to select an alternate potential winner provided sufficient time exists to confirm and verify the alternate potential winner. Winner and travel companion must travel on same itinerary and participate in all Grand Prize-related activities together

If the Grand Prize winner is a minor in his/her State of residence, (i) the Grand Prize winner’s parent or legal guardian must execute all Sweepstakes forms required by Sponsor and (ii) the Grand Prize winner’s traveling companion must be the Grand Prize’s winner’s parent or legal guardian..

Decisions made by Sponsor are final in all matters, including interpretation of these Official Rules and awarding of the Prizes, and cannot be appealed. By entering this Sweepstakes, each entrant hereby waives any claim of ambiguity in the Sweepstakes and these Official Rules, No substitutions of the prizes are offered, except that Sponsor and the Sponsor Entities reserve the right in their sole discretion to substitute a prize(s) or any portion of a prize(s) for a prize(s) of equal or greater value. No transfer of a prize to a third party is permitted and the cash value of a prize(s) will not be awarded in lieu of a prize where it applies, except in Sponsor’s sole discretion. Any applicable federal, state and local taxes, including, without limitation, excise tax (including sales tax), and other expenses not specifically set forth herein are the sole responsibility of the prize winners (as applicable). The value of the prizes set forth above represents Sponsor’s good faith determination of the approximate retail value thereof and that determination is final and binding and cannot be appealed. The prize winner will not receive any difference between the actual and approximate retail value.

Sponsor is not responsible if any scheduled event is delayed, postponed or cancelled fore any reason, in which event that portion of the prize is forfeited in its entirety and no compensation, substitution or cash equivalent will be provided to prize winner.

If the Grand Prize winner becomes disabled or cannot otherwise participate in the Grand Prize activities at any time due to illness, Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of the Grand Prize or any part thereof. Sponsor and Sweepstakes Entities are not responsible for any fees or additional charges resulting from Grand Prize Winner’s or guests’ change of accommodations.

5. LIMITATION ON LIABILITY/DISCLAIMER:

Any attempted form of entry into the Sweepstakes other than as described herein is void. No mechanical reproductions, alterations, or forged entries allowed. Sponsor reserves the right, at its sole discretion, to disqualify any individual (and his/her entry) who tampers with the entry process.

Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a Prize will forfeit the Prize won and may be prosecuted to the fullest extent of the law. All federal, state and local laws and regulations apply. Each entrant agrees not to knowingly: damage or cause interruption of the Sweepstakes; prevent others from using the Sweepstakes; or obtain or modify another user's account information without their consent.

CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL AND/OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY SWEEPSTAKES ENTRANT MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor and Sponsor Entities are not responsible for delay in operation or transmission, communications line failure or for lost, late, delayed, undelivered, corrupted, incomplete, destroyed, forged, illegible, damaged, tampered with, mass machine generated, unintelligible, incomprehensible, misdirected entries, otherwise not in compliance with these Official Rules. Sponsor and Sponsor Entities are also not responsible for typographical, printing, clerical or human errors (and Sponsor and Sponsor Entities reserve the right to correct typographic, clerical or printing errors in any Sweepstakes materials), technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an entrant’s ability to participate in the Sweepstakes, damage to user’s or another party’s computer system as a result of participation in the Sweepstakes or downloading any information necessary to participate in the Sweepstakes or for errors in the administration of the Sweepstakes or in the announcement of prizes including without limitation, such error as may give an erroneous indication that a prize has been won.. Sponsor reserves the right in its sole discretion to cancel, terminate, suspend or modify the Sweepstakes if, in the sole judgment of the Sponsor, the Sweepstakes is not capable of running as planned, including, without limitation, any computer virus, malfunction, tampering, unauthorized intervention, fraud, technical failure or other cause beyond its control which corrupts, threatens or adversely affects the administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of a dispute as to the identity or eligibility of a prize winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at time of entry. “Authorized Account Holder” shall mean the natural person18 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event that production, technical, programming or any other reasons cause more than the state number of Prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

As a condition of entry, you agree to be bound by these Official Rules and the decisions of Sponsor. Except where prohibited by law, by entering this Sweepstakes, you consent to (i) the use of your name, voice, picture, likeness and biographical data and/or any other information contained in your entry in advertising, promotional and marketing materials by Sponsor and the Sponsor Entities worldwide in all media now known or hereafter discovered (including Sponsor’s and Sponsor Entities’ web sites) without additional compensation, notice, consent, approval or review and (ii) the modification, editing, adaptation, electronic alteration, use, assignment and/or disposal of on-line entries however Sponsor sees fit and for any purpose without any compensation, notice, consent, approval or review to you. You acknowledge that if you are chosen as a winner, certain of your personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a Winners’ List.

All prize claims and documents provided by the winners must be verified by Sponsor.

EACH winner, by acceptance of a Prize, agrees to release Sponsor AND the Sponsor Entities from AND AGAINST any and all liabilitIES, claims, DEMANDS, LOSSES, DAMAGES or actions of any kind whatsoever for injuries, death, disability, attorneys’ fees, costs of litigation and settlement as well as damages or losses to persons and property that may be sustained In connection with OR WHICH ARISE OUT OF, DIRECTLY OR INDIRECTLY, the receipt, ownership, REDEMPTION, use OR MISUSE, LOSS OR MISDIRECTION of A Prize or while traveling to and/or from a location to obtain or use A Prize OR ANY PORTION OF A PRIZE AND HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL aND CONSEQUENTIAL DAMAGES (UNLESS OTHERWISE PROHIBITED) AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHREWISE INcrEASED.

Neither Sponsor nor the Sponsor Entities make any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any Prize including, without limitation, quality, merchantability, or fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.

Sponsor and Sponsor Entities shall not be liable to any winner or any other person for failure to supply a prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control. Sponsor and Sponsor Entities shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor and Sponsor Entities shall not be liable for any lost, misdirected or damaged baggage.

6. GOVERNING LAW.

Any and all legal actions or claims arising in connection with this Sweepstakes shall be resolved individually without resort to any form of class action and shall be brought only in the courts located in Los Angeles County, California. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred including, without limitation, costs associated with entering this Sweepstakes, but in no event attorneys’ fees. These Official Rules and the Sweepstakes shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of California.
