GMC Yukon Giveaway Official Rules

THE GIVE-AWAY ("GIVE-AWAY") IS VALID IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ("D.C."). VOID ELSEWHERE AND WHEREVER PROHIBITED (SEE BELOW FOR FURTHER ELIGIBILITY RESTRICTIONS). YOU MAY NOT ENTER THE GIVE-AWAY UNLESS YOU ARE 21 YEARS OF AGE OR OLDER AND A LEGAL RESIDENT OF, AND PHYSICALLY RESIDING IN, ONE OF THE 50 UNITED STATES OR D.C. ON DATE YOU SUBMIT ENTRY FORM.

You can submit an entry form for Ellen's GMC Yukon Hybrid Give-Away (the "Give-Away") starting at 6:30 p.m. Pacific Time (PT) on April 22, 2008. The deadline for submitting entry forms is 11:59 p.m. PT on May 9, 2008.

Who's eligible to submit an entry for the Give-Away? People who are at least 21 years of age on the date they fill out the on-line form described below to be considered for the Give-Away. You must also be a legal resident and physically located within the 50 United States or D.C. You are not eligible to submit an entry form for the Give-Away if you are an employee of WAD Productions, Inc., the Show, broadcast licensees of The Show, Time Warner, Warner Brothers Entertainment, Telepictures Productions, Inc., General Motors Corp. and all of their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, distributors, advertising, promotion and public relations agencies and their respective officers, directors, employees, agents, independent contractors, representatives and agencies, assigns, successors, licensees, broadcasters and distributors (collectively, the "Releasees"), an immediate relative of an employee or live in the same household as an employee of a Releasee.

In addition to submitting an entry form and essay, eligible participants in the Give-Away must be able to travel to Los Angeles, California (at the expense of the Show as further detailed below) on May 11, 2008, attend the videotaping of the Show on May 12, 2008 and stay in Los Angeles until as late as May 13, 2008.

What information do I need to provide on the Give-Away entry form? The entry form will include ten (10) multiple-choice questions about the Show which you must answer ("Show Questions"). Only those entrants who have answered all questions correctly will be considered. In addition, you will be required to give your name, complete mailing address, e-mail address, telephone number (with area code), birth date and a brief essay describing why you need a car. Limit: one (1) entry per person/e-mail address.
When is the deadline for submissions? 11:59 p.m. Pacific Time on May 9, 2008.
How is the person chosen who will receive the car? Up to three (3) finalists will be chosen after a telephone interview by the Show's producers to attend the videotaping of the Show in Los Angeles on May 12, 2008. One (1) person will be selected by producers of The Ellen DeGeneres Show (the "Show") based on correctly answering all Show Questions and the essay; the recipient of the car will be announced on or about May 12, 2008.
What is the prize? Round trip economy airfare for finalist and one (1) traveling companion from the major airport nearest the finalist's home (as determined by the Show in its sole discretion) on an airline selected by the Show in its sole discretion to Los Angeles California on May 11, 2008 (returning on May 12 or May 13, 2008 as determined by the Show); hotel accommodations in Los Angeles (single room; double occupancy); ground transportation from hotel to studio where the Show is videotaped; attendance at the Show on May 12, 2008; one (1) 2008 GMC Yukon Hybrid 2-mode automobile Approximate retail value of all prizes: $58,646.00

Car recipient must take delivery of the car within ninety (90) days following deliver to a GMC dealership in or near recipient's city of residence. Delivery date and time will be determined by GMC and/or Show. Car recipient is responsible for all costs associated with any available upgrade/option packages and any other expenses related to the acceptance and use of the car not specified herein. Color of car, options and equipment will be determined by GMC and Show in their sole discretion. Car recipient will be solely responsible for registration, license, title and insurance fees. Car recipient may be required to show proof of insurance and a valid driver's license will be required prior to taking delivery of and/or picking up the car as directed by Show. The Automobile awarded may differ from any vehicle shown in Give-Away or other promotional materials. Reservations and airline tickets are non-refundable for cash or credit, non-transferable and non-changeable once issued. The tickets cannot be sold, exchanged or bartered. If lost or destroyed, they will not be replaced. Each finalist and his/her guest are responsible for insurance and any other required travel documents, including valid identification. All expenses not specifically set forth herein including, without limitation, meals, beverages, telephone charges, movie charges, pay-per-view television charges, hotel room-service charges, merchandise, souvenirs, and any other incidental costs and expenses shall be the sole responsibility of each finalist and his/her guest who incur such charges. Traveling companion must be at least 18 years of age or older on departure date and not a minor in his/her state of residence, unless finalist is parent or legal guardian of travel companion. All details of the prize are at Show's sole discretion. If finalist is unavailable to travel on dates specified by Show, the prize will be forfeited and the Show shall have the right to select an alternate potential winner provided sufficient time exists to confirm and verify the alternate potential winner. Winner and travel companion must travel on same itinerary and participate in all Give-away related activities together. The Show is not responsible for lost or damaged luggage.

How will I find out if I was chosen to receive the car? You will be notified via telephone and/or e-mail on or about May 10, 2008 that you, subject to verification by the producers of the Show that you meet all applicable eligibility requirements, have been selected as a finalist in the Give-Away. You will be required to fly to Los Angeles on May 11, 2008 and attend the videotaping of the Show in Los Angeles on May 12, 2008. The recipient of the car will be announced during the videotaping on May 12. If (i) you cannot be reached, (ii) you fail to respond to the notification, (iii) you decline the trip to Los Angeles, and/or (iv) your notification is returned as undeliverable, an alternate recipient may be selected in the Show's sole discretion. The Show representative is not obligated to leave a voice mail message on your answering machine nor is that representative required to send more than one e-mail notification to you. If you, (i) within twelve (12) hours of the notification, (a) fail to return a completed affidavit of eligibility, liability/publicity release, or other documents(s) as required by the Show, or (b) fail to provide the Show with a copy of your valid government issued photo identification or social security number; and/or (ii) are found to be ineligible in the Show's sole discretion, an alternate recipient may be selected at the Show's sole discretion. The Show reserves the right to modify the notification and affidavit/release procedures in connection with the selection of an alternate recipient, if any. The address you provide on your entry form will serve as the address of record in respect of all mailings to you. Changes to that mail address may serve as a basis for disqualification.
Are there any other things I need to know before submitting my entry form? Yes there are and by submitting an entry form you agree to the following additional guidelines:

By submitting an entry, you agree that decisions made by the Show in connection with the Give-Away are final and binding in all matters, including interpretation of these Guidelines and awarding of the car, and cannot be appealed. By entering this Give-Away, each entrant hereby waives any claim of ambiguity in the Give-Away and these Guidelines. No substitution for the car will be offered. You cannot transfer the car to a third party and the cash value of the car will not be awarded in lieu of the car. Any applicable federal, state and local taxes, including, without limitation, excise tax (including sales tax), and other expenses not specifically set forth herein are the sole responsibility of the car recipient. The value of the car awarded and set forth above represents the Show's good faith determination of the approximate retail value thereof and that determination is final and binding and cannot be appealed. Any difference in the actual value of the car and the approximate retail value of the car stated in these Guidelines will not be awarded in cash.

Any person who supplies false information, enters the Give-Away by fraudulent means, or is otherwise determined to be in violation of these Guidelines in an attempt to obtain one of the franchises will forfeit the franchise awarded and may be prosecuted to the fullest extent of the law. All federal, state and local laws and regulations apply to the Give-Away.

The Show is not responsible for lost, late, corrupted, incomplete, destroyed, forged, illegible, damaged, tampered with, mass machine generated, unintelligible, incomprehensible, misdirected entries, or entries otherwise not in compliance with these Guidelines. The Show is not responsible for typographical or human errors, technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an entrant's ability to participate in the Give-Away or damage to your system as a result of participation in the Give-Away or downloading any information necessary to participate in the Give-Away. The Show each reserves the right in its sole discretion to cancel, terminate, suspend or modify the Give-Away if, in the Show's sole judgment, the Give-Away is not capable of running as planned, including, without limitation, any computer virus, malfunction, tampering, unauthorized intervention, fraud, technical failure or other cause beyond its control which corrupts, threatens or adversely affects the administration, security, fairness, integrity or proper operation of the Give-Away, or any cause affecting the awarding of the franchise.

As a condition of submitting an entry, you agree to be bound by these Guidelines and the decisions of the Show. Except where prohibited by law, by submitting an entry, you consent to (i) the use of your name, voice, picture, likeness and biographical data and/or any other information contained in your entry in advertising, promotional and marketing materials by the Show and the Releasees worldwide in all media now known or hereafter discovered (including the Show's and the Releasees' web sites) without additional compensation, notice, approval or review and (ii) the modification, editing, adaptation, electronic alteration, use, assignment and/or disposal of your entry however they see fit and for any purpose without any notice or compensation to you.

By participating in this Give-Away, entrants agree to release the Releasees from any liability whatsoever for any claims, costs, injuries, expenses (including, without limitation, attorneys' fees, court costs, costs of settlement and disbursements) losses or damages of any kind arising out of or in connection with participation in the Give-Away, or the downloading or accessing of entry materials, or the redemption, acceptance, possession or use/misuse of any prize awarded herein, or travel to or from, or participation in, any prize-related activity (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVE-AWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SHOW RESERVES THE RIGHT TO DISQUALIFY AND TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Any and all legal actions or claims arising in connection with this Give-Away shall be resolved individually without resort to any form of class action and shall be brought only in the courts located in Los Angeles County, California. These Guidelines and the Give-Away shall be governed by and construed in accordance with the laws of the State of California
